Pluton AI: Image Generator Terms of Service

These Terms of Service ("Terms") govern your use of Pluton AI: Image Generator (the "app"), provided by 96dev ("Pluton AI", "we", "us", or "our"). By using the app, you agree to these Terms. If you do not agree, do not use the app.

1. What Pluton AI provides

Pluton AI offers tools to create, edit, enhance, upscale, explore, save, and manage AI-generated images. Features may include reference-image editing, avatar creation, prompt enhancement, a private image history, public inspiration content, credits, and paid plans.

Some features require an internet connection, a Google account, enough credits, an active subscription, or an available third-party service. AI generation and prompt enhancement are provided through our backend and third-party AI providers, including providers available through fal.ai. Explore may show public content from Civitai or other sources.

2. Who may use the app

You must be at least 13 years old. If you are under the age of legal majority where you live, use the app only with permission from a parent or legal guardian. You may not use the app if applicable law prohibits you from doing so.

3. Your account

You may sign in with Google to sync your images, avatars, credits, and subscription status. Keep your Google account and device secure, provide accurate information, and do not impersonate anyone.

You can sign out at any time. You can permanently delete your Pluton account from Me > Delete account. Deletion removes the account and associated cloud data, subject to limited retention for legal, billing, security, backup, fraud-prevention, and abuse-prevention purposes. It does not remove images saved to your device or cancel an active Google Play subscription.

4. Your content

"Your Content" includes prompts, reference images, uploaded photos, generated images, reports, feedback, and anything else you submit, create, or save through Pluton AI.

You are responsible for Your Content. By submitting it, you confirm that:

• you have the rights and permissions needed to use it;
• it does not violate anyone's privacy, image rights, publicity rights, intellectual property rights, or other legal rights;
• you have appropriate consent before uploading an image of another person;
• you understand that content sent to AI features is processed by cloud and AI providers.

You keep the rights you already have in Your Content. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, transform, and display Your Content only as reasonably needed to operate, secure, and support the app and provide the features you request.

5. AI-generated images

AI results can be inaccurate, unexpected, similar to results created for others, or unsuitable for your intended use. Review every result before you use, publish, sell, or rely on it.

To the extent allowed by applicable law and our providers' terms, we assign to you any rights we may have in images generated for you. This does not give you rights to third-party content, public Explore images, AI models, Pluton AI software, provider technology, or any source material you did not have permission to use.

We do not promise that a generated image is unique, copyrightable, free from third-party claims, suitable for commercial use, or accepted by any platform, marketplace, advertiser, or authority.

6. Plans, subscriptions, and credits

The app may offer free credits, paid features, or recurring subscriptions. The price, billing period, included credits, and benefits shown at checkout apply to your purchase. Available plans and benefits may change for future purchases.

Android purchases are processed through Google Play, with RevenueCat helping us manage subscription access. Google Play handles payment, renewal, cancellation, and eligible refunds under its policies. We do not receive your full payment card details.

Subscriptions renew automatically unless you cancel before the next billing date. Manage or cancel your subscription in Google Play. Signing out, uninstalling the app, or deleting your Pluton account does not cancel it.

Credits and plan benefits:

• can be used only inside Pluton AI, have no cash value, and cannot be transferred;
• may reset or expire according to the plan details shown in the app;
• are charged when processing starts, including separate charges for prompt enhancement or other requested AI steps;
• are not automatically returned if processing starts but a result cannot be completed, delivered, or saved.

We may correct, reverse, refuse, or limit credits or benefits caused by an error, fraud, abuse, or unauthorized activity. Nothing in these Terms limits refund or consumer rights that applicable law or Google Play policy gives you.

7. Acceptable use

You must not use Pluton AI to create, request, upload, edit, publish, or share content that:

• is illegal, fraudulent, deceptive, or intended to cause harm;
• sexually exploits, sexualizes, endangers, or abuses a minor;
• contains non-consensual intimate imagery or sexualized imagery of a real person without consent;
• promotes hate, harassment, bullying, threats, terrorism, self-harm, or dangerous illegal activity;
• violates privacy, image rights, publicity rights, copyright, trademark, or other intellectual property rights;
• impersonates someone or falsely suggests a real person's identity, endorsement, or actions;
• makes deceptive political, medical, financial, legal, or other high-impact claims;
• contains malware, spam, scraping, automated abuse, or unauthorized data collection.

You must also not bypass or interfere with safety filters, model restrictions, rate limits, credits, subscriptions, authentication, or security controls; reverse engineer or disrupt the app; or use the service in a way that harms Pluton AI, our providers, or other users.

We may block a prompt, refuse a request, remove content, limit features, revoke improperly obtained credits, suspend an account, or report activity when we reasonably believe these Terms, provider rules, Google Play policies, or the law have been violated.

8. Reporting harmful content

Use any available in-app report control or email [email protected] to report illegal, harmful, offensive, or policy-violating content. Include enough detail for us to find and review it, such as the image, link, date, account, prompt, or reason for the report.

We may review the report, remove content, restrict an account, or take another appropriate step. We cannot promise a particular result for every report.

9. Third-party services and public content

The app relies on services such as Google Sign-In, Google Play, RevenueCat, Cloudflare, fal.ai, AI model providers, and Civitai. Their own terms and policies may also apply when you use their services.

Public Explore images and prompts may belong to third-party creators or platforms. Pluton AI does not claim ownership of that content and does not promise that you may copy, reuse, or sell it. Check the source, license, and attribution requirements before using third-party content.

10. Permissions and saved files

The app may ask for access to selected photos or media so you can use reference images and save results. You can deny or revoke permission in device settings, but the related feature may stop working. You control images saved to your device through your Photos, Gallery, or Files app.

11. Pluton AI's intellectual property

The app's software, interface, branding, logos, design, databases, and service infrastructure belong to us or our licensors and are protected by intellectual property laws. These Terms do not transfer ownership of Pluton AI or third-party technology to you.

Except where the law allows it, you may not copy, reverse engineer, modify, resell, rent, sublicense, interfere with, or misuse the app without our written permission.

12. Changes and availability

We may update, limit, suspend, or discontinue a feature for maintenance, security, legal compliance, provider changes, or product improvements. This may affect models, prices, credits, plan benefits, safety rules, limits, or supported platforms. We do not promise that every feature or model will always be available.

13. Disclaimer

To the extent allowed by law, Pluton AI is provided "as is" and "as available." We do not guarantee uninterrupted, error-free, completely secure, or accurate operation, or that the app will meet every intended use. Pluton AI does not provide legal, financial, medical, identity-verification, or other professional or safety-critical advice.

14. Limitation of liability

To the maximum extent allowed by law, 96dev and Pluton AI are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, third-party claims, or misuse of generated content.

Our total liability for claims related to the service will not exceed the greater of the amount you paid to Pluton AI during the three months before the event giving rise to the claim or USD 50, unless applicable law requires otherwise.

These limitations do not exclude rights or liability that cannot legally be excluded.

15. Suspension and termination

You may stop using the app at any time. We may suspend or end access if you violate these Terms, create risk for Pluton AI or others, misuse the service, or if law or a provider requires us to do so.

Provisions that should reasonably continue after termination will remain in effect, including content licenses, ownership, disclaimers, liability limits, and governing law.

16. Governing law

These Terms are governed by the laws of Vietnam, without limiting any mandatory consumer rights you have under the laws where you live.

17. Changes to these Terms

We may update these Terms as the app or legal requirements change. If an update materially affects your rights, we will provide reasonable notice in the app, on our website, or through another appropriate method. The date at the top shows when these Terms were last updated. By continuing to use the app after updated Terms take effect, you agree to them.
